In our practice, we deal with issues relating to transmission equipment from the perspective of both transmission companies and owners (perpetual usufractuaries) of real estate occupied by such transmission infrastructure. Our experience in the provision of legal advice to the both groups gives us a broader view of a given issue.
Mostly, we assist in dealing with issues of the past, i.e. regarding the existing network infrastructure, but we also look for optimum solutions for obtaining legal titles to real estate for newly completed transmission investments.
Our legal assistance with regard to the issues relating to transmission equipment includes in particular:
- representing Clients in matters related to regulating the legal status of transmission equipment, both at the stage of negotiations and court or administrative proceedings (e.g. establishment of transmission easement, removal or change of location of transmission equipment, acquisition of transmission easement by prescription, payment of compensation for non- contractual use of real property, issuance of administrative decisions restricting the use of real properties)
- drafting legal opinions and recommendations regarding the issues related to transmission equipment (e.g. assessment of the validity of claims or verification of the legal status of various transmission equipment)
- providing legal advice on the implementation of solutions aiming at regulating the legal status in a way allowing the use and operation of transmission equipment
- drafting, negotiating and reviewing documents forming the basis for transactions between land owners and transmission companies
